Bernard Alexander, founder of Alexander Morrison + Fehr LLP, was recently featured on the LawPods podcast, where he discussed the unique challenges and opportunities that come with representing employees in workplace discrimination, harassment, and retaliation cases.
During the interview with hosts Harry Plotkin and Dan Kramer, Bernard shared his perspective on why employment litigation is different from many other areas of law. Because most jurors have worked for an employer at some point in their lives, they can often relate to the experiences of employees who bring workplace claims.
A significant portion of the conversation focused on jury selection, also known as voir dire. Bernard explained that one of the most important goals during jury selection is helping potential jurors understand the experiences of the client. He described how he encourages jurors to discuss their own experiences with workplace issues by asking direct questions about discrimination, harassment, and internal complaints.
Bernard’s insights are informed by decades of trial experience, including his role in securing a $136 million verdict against Tesla in a workplace harassment case, which was the largest single-plaintiff harassment verdict in the United States at the time.
The podcast provides valuable insight into how employment cases are tried, how juries evaluate workplace disputes, and why effective communication is critical throughout the litigation process.
